Art. 63 Transfer of risk - Consumer Code
In contracts that impose on the merchant the obligation to arrange for the shipment of the goods, the risk of loss or damage to the goods, for reasons not attributable to the seller, is transferred to the consumer only when the latter, or a third party designated by him and different from the carrier, physically takes possession of the goods.
However, the risk is transferred to the consumer already at the time of delivery of the goods to the carrier if the latter was chosen by the consumer and such choice was not proposed by the merchant, without prejudice to the consumer's rights against the carrier.
