GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale govern the sale of products through the website zoraido.com, owned by the company Piero SRLS, via Giuseppe Garibaldi 8, 40066 Pieve di Cento (BO), info@zoraido.com. The sale of products by third-party sellers will be governed by the terms and conditions of sale applicable from time to time.

Zoraido invites the customer/buyer to read these General Terms and Conditions of Sale carefully before making any purchase. By making any purchase, the customer accepts these General Terms and Conditions of Sale in their entirety. Sales contracts relating to Zoraido are considered concluded at the moment the purchase order placed by the customer is received (by clicking on the "Buy" button). By electronically sending their purchase order, the customer declares that they have read and accepted these general conditions of contract and undertakes to observe and respect them in their dealings with Zoraido.

CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

If you wish to purchase one or more products shown on the site, they may be selected one at a time by adding them to the cart. Once all the items to be purchased have been selected, the customer can close the cart and submit the order. At this point, a summary page will appear showing the selected products, their price, and the delivery options (with related costs). The customer will be asked to choose their preferred delivery, shipping, and payment method. At the bottom of the same page, you will find the "Buy" button, which you must click to submit the order to us. The order will then be considered a contractual proposal to purchase the listed products from Zoraido, considered individually. Upon receipt of the order, an e-mail confirming receipt of the order (Order Confirmation E-mail) will be automatically sent to the customer, which, however, does not constitute acceptance of the purchase proposal. By sending the Order Confirmation E-mail, Zoraido merely confirms that it has received the order and has subjected it to a data verification and product availability process. The sales contract with Zoraido will be concluded only when a separate e-mail accepting the purchase proposal is sent to the customer, which will also contain information regarding product shipment and the estimated delivery date (Shipping Confirmation E-mail). In the event that an order is fulfilled via multiple shipments, the customer may receive separate Shipping Confirmation E-mails. The customer may freely cancel their order before receiving the Shipping Confirmation E-mail, provided that the order has not already been prepared for the shipping process. In this case, no cost will be charged. This is without prejudice to the right of withdrawal under the terms and conditions set out in the following article. The electronic invoice relating to an order will be sent to the customer in the Shipping Confirmation E-mail.

PAYMENT AND DELIVERY OF PRODUCTS

The customer can make the due payment by choosing one of the following listed methods. Credit card payment: In the event that the customer intends to make the payment by credit card, they may use the payment procedure via PayPal, which is suitable for ensuring the confidentiality of the data provided by customers. For any information and further legal agreements, the customer is referred to the website www.paypal.com

The purchased product, together with the relative invoice, will be delivered by courier to the address specified by the customer at the time of the order. In case of non-delivery due to the absence of the recipient at the address indicated in the order, the courier will leave a notice and will try a second time; if the recipient is still absent, the goods will be returned to the sender.

RIGHT OF WITHDRAWAL, EXCEPTIONS AND RETURN POLICIES

Right of withdrawal

Without prejudice to the exceptions indicated below, the customer has the right to withdraw from the order placed, without having to provide any reason, within 14 days from the day they received the ordered product.

The customer must communicate the exercise of the right of withdrawal to Zoraido, via Giuseppe Garibaldi 8, 40066 Pieve di Cento (BO), info@zoraido.com, by certified electronic mail (PEC).

In order to exercise the right of withdrawal, it is necessary that the aforementioned communication is sent before the expiry of the 14-day period and that the product is returned by post or courier to Zoraido, via Giuseppe Garibaldi 8, 40066 Pieve di Cento (BO), info@zoraido.com.

Zoraido will refund all payments received in relation to the product for which the right of withdrawal has been exercised (including shipping costs incurred for the return of the item) by bank transfer to the details indicated by the customer in the withdrawal notice, within 14 days from the day Zoraido received the communication regarding the exercise of the right of withdrawal. Zoraido may withhold the refund until it has received the returned product. The customer will bear the direct costs of returning the products; these costs will be refunded by Zoraido together with the refund of the product price. The customer may be held liable for any decrease in the value of the goods resulting from handling the goods (other than what is necessary to establish the nature, characteristics, and functioning of the goods).

Exceptions to the right of withdrawal

The right of withdrawal does not apply in the case of:

- the supply of sealed goods which are not suitable for return for hygiene or health protection reasons and which have been opened after delivery, or in the case of the supply of products that, after delivery, are inseparably mixed with other goods;

- the supply of goods made to measure or clearly personalized;

Return policies

All products purchased on the zoraido.com website can be returned within 14 days of delivery, provided they are intact, unused, and undamaged. Sealed products will be accepted only if the protective film and/or the packaging are intact. Products must be returned by post/courier and properly packed.

In these cases, only the price paid for the purchase will be refunded. Shipping costs incurred for the return of the item will not be refunded. The risks deriving from transport and the costs of return will be at your sole expense. These provisions are additional and do not prejudice your rights deriving from the law, nor the right of withdrawal within 14 days described above.

PRICES AND AVAILABILITY

All prices are inclusive of VAT applicable under the law. Information on the availability of products for sale is listed on the site, as well as on the presentation page of each product. Please note that the estimated shipping and delivery times of products are purely indicative and cannot be relied upon entirely. Once the order is received, you will be notified via e-mail if any of the ordered products are not available. If, due to errors or other inconveniences, the price indicated on the site is lower than the correct selling price of a product, the customer will be contacted to verify whether they still wish to purchase the product at the correct price; otherwise, the order cannot be accepted. If the correct price of a product is lower than that indicated on the site, only the correct lower price will be charged to the customer and the product will be shipped anyway.

CUSTOMS

If goods ordered on zoraido.com are to be delivered outside Italy, the customer may be subject to import duties and taxes, which are payable once the package reaches the specified destination. Any additional costs for customs clearance will be borne by the customer. Zoraido has no control over these costs and cannot predict their amount. Customs policies vary considerably from country to country; therefore, the customer must contact their local customs office for further information. The customer is required to be aware of the fact that when placing orders on the site, they are considered the importer and are therefore required to comply with all the legislation and regulations of the country where the goods will be shipped and received.

WARRANTIES ON SOLD PRODUCTS AND LIMITATIONS OF LIABILITY

The warranty regime for products sold by Zoraido differs depending on whether the buyer is a "consumer" or a "professional" pursuant to Directive 1999/44/EC concerning "certain aspects of the sale of consumer goods and associated guarantees".

If the customer purchases as a "consumer", they benefit from the legal guarantee of conformity that the seller is required by law to provide on every good sold ("Legal Guarantee"). The Legal Guarantee guarantees the good against defects of conformity with respect to the sales contract.

Under the law, in the event of the applicability of the Legal Guarantee, the customer will have the right to have the conformity of the good restored without charge by repair or replacement, or, if this is not possible, to a reduction in the purchase price or termination of the contract. Zoraido is therefore liable for defects of conformity if they manifest within two years from the date of delivery of the good. The customer will still have the burden of reporting the defect of conformity within two months of its discovery, by registered letter or by certified electronic mail (PEC) to Zoraido, via Giuseppe Garibaldi 8, 40066 Pieve di Cento (BO), info@zoraido.com.

Zoraido will not be responsible in the event of non-substantial differences between the purchased goods and their illustrative images and text descriptions published on zoraido.com

Except in the case of willful misconduct or gross negligence, Zoraido is solely responsible for any direct and foreseeable damage at the time the sales contract is concluded. Zoraido is not therefore responsible for any losses suffered, loss of profit, or any other damage that is not an immediate and direct consequence of its breach or that was not foreseeable at the time the sales contract was concluded. Zoraido is in no way responsible for the fulfillment of obligations by third parties who may offer commercial guarantees in relation to products for sale on zoraido.com.

APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed and must be interpreted in accordance with Italian law, and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. The customer agrees, and Zoraido in turn agrees, to submit to the non-exclusive jurisdiction of the court of Bologna. As a consumer, the customer may thus take action before the Court of Bologna or that of the European Union Member State where they are resident or domiciled to promote a dispute in relation to these General Terms and Conditions of Sale.

CHANGES TO THE GENERAL TERMS AND CONDITIONS OF SALE

Zoraido reserves the right to change the site, policies, and these General Terms and Conditions of Sale at any time to offer new products or services, or to comply with legal or regulatory provisions.

WAIVER

In the event of a breach by the customer of these General Terms and Conditions of Sale, Zoraido's failure to exercise its right to take action against them does not represent a waiver of its right to take action for the breach of commitments undertaken by the customer themselves.
